1. How The Programme Works

This Referral Programme allows existing customers of Outcome Diagnostics Ltd, trading as Medic Spot Limited, who are subscribed to various programmes, including Weight Loss Programmes and a separate Behavioural Change Course, to refer friends. When a referred friend signs up and pays for their first month of a Medic Spot Limited Weight Loss Programme or the Behavioural Change Course, both the referrer and the referred friend receive a discount as detailed below. Referrers and Referred Friends must be aged between 18 and 75 and reside in the United Kingdom to qualify for participation in the Referral Programme.

1.1. Medic Spot Limited’s referral programme shall strictly adhere to the MHRA guidelines that prohibit the direct or indirect promotion of specific prescription-only medicines to the public. Any language or content that could be construed as promoting such medicines is not permitted.

1.2. All related communication must avoid implying or encouraging the selection of specific POMs, as per MHRA regulations.

1.3. Rewards provided as part of this Referral Programme are solely related to the act of referring a friend to join Medic Spot Limited’s services. For programmes involving Prescription Only Medicines (POMs), rewards do not suggest, imply, or promote the prescription or endorsement of any specific prescription-only medicines. The behavioural change course, which does not involve POMs, follows a separate set of referral communication rules.

2. A Referral Is

A referral is considered successful when a referred friend completes their first purchase of the Medic Spot Limited Weight Loss Programme or Behavioural Change Course. Only after the referred friend’s payment is successfully processed and not refunded, disputed, or charged back will the referral be deemed complete. This completion triggers the rewards for both the referrer and the referred friend.

3. Rewards And Offers

Upon a successful referral, the following rewards are offered:

• Referrer Reward: The referrer will receive £50 off their next order.
• Referred Friend Reward: The referred friend will receive £50 off their first month subscription or Behavioural Change Course order.

4. Issuing Of Rewards And Offers

Rewards will be issued within 30 days following the successful completion of the purchase of a weight loss programme or course by the referred friend. To qualify for the reward, the referrer must be an active subscriber at the time the reward is issued. The referred friend must have completed their first month’s payment and continued into the second month of the subscription.

5. Privacy

All personal information collected and processed as part of this Referral Programme will be used in accordance with Medic Spot Limited’s Privacy Policy, available at www.medicspot.co.uk/privacy-policy. Under the applicable laws and regulations, Medic Spot Limited shall be responsible for collecting and processing such personal information.

5.1. Personal information collected must comply with privacy standards outlined in the Medic Spot Limited Privacy Policy and UK advertising guidelines. Information shared must not inadvertently promote POMs, adhering strictly to patient confidentiality and MHRA regulations.

6. Guidance on Referral Communication

To ensure compliance with MHRA regulations, participants must use non-promotional and factual language when referring friends. Referrers should use private, direct channels (e.g., personal emails, direct messaging) for all referral communications to minimise the risk of broad public promotion that could be considered advertising. Below are examples of compliant statements for different types of programmes:

• For weight loss programmes:
  • “I’m part of a weight loss programme with Medic Spot Limited that has been working well for me. If you’re interested, I can share a referral code for you.”
  • “Medic Spot Limited offers a weight management service with medical consultations. Let me know if you want a referral code to check it out.”
• For the behavioural change course:
  • “Medic Spot Limited has a comprehensive behavioural change course for weight management support. I can share a referral code if you’re interested.

Important Note: Participants must avoid mentioning or implying specific POMs or making claims that promote any POMs. All referrals should focus on the service and general programme benefits without referencing specific medication names or their effects.

7. Examples of Non-Compliant Referral Communication

To remain compliant with MHRA regulations, participants must avoid using any language that could be considered promotional or imply the endorsement of specific prescription-only medicines (POMs). Below are examples of statements not to use when referring a friend:

• “Join Medic Spot Limited’s programme and get access to [specific medicine name] for weight loss.”
• “This programme prescribed me the best medication, and you can get it too!”
• “You should try Medic Spot Limited’s weight loss programme—they prescribe [mention of specific POM] that works wonders.”
• “With this referral, you can get the same powerful medicine I’m using for weight management.”
• “Sign up and get discounted treatment with [specific medicine], which really helped me lose weight quickly.”

Important Note: Referrers must avoid making any mention of specific medications, their benefits, or implications that suggest guaranteed results. Referrals should focus on the overall service and experience without promoting or implying the use of specific POMs, as this contravenes UK advertising laws and MHRA guidelines.

8. General

7.1. These Referral Terms are published by Medic Spot Limited (“we”, “us”, and “our”). Our Referral Programme as displayed on our Website www.medicspot.co.uk and these Terms form a binding agreement for both Referring Users (“you” or “your(s)”) and people who receive our referral invitation.

7.2. This Referral Programme permits you to invite your contacts to participate in one or more Referral Programme(s).

7.3. You may only invite personal friends, family members, acquaintances, and colleagues to this Referral Programme.

7.4. Any digital representation of the programme must not use phrases or features like ‘Buy Now’ or icons that suggest direct purchasing of POMs.

7.5. Programme descriptions on websites and platforms should clearly indicate that all decisions regarding prescription and use of medicines are based on consultations with qualified healthcare professionals.

9. Completed Referrals and Limit

9.1. A Completed Referral is when a Referring User refers this Programme to one of its contacts, leading to a purchase as defined above.

9.2. Each Referring User may refer up to 7 friends.

9.3. All referred people must be new and first-time Users. Existing Users cannot participate in and benefit from the Referral Programme.

9.4. You represent all personal information is 100% correct and up to date. We may monitor your use of the Referral Programme or request your ID to verify your identity before issuing rewards.

10. Restrictions

10.1. This Programme cannot be combined with other Medic Spot Limited’s referral programmes, discounts, vouchers, benefits, or incentives. By participating in this Referral Programme, we may restrict you from any other promotion, programme, discount, or vouchers.

10.2. Participants must ensure that their referral communications comply with anti-Spam legislation and avoid any reference to specific POMs to prevent contravening advertising laws related to POMs.

10.3. You understand and agree that you must not use referral methods that are bothersome to the recipients. Moreover, your participation in the Referral Programme must not violate the applicable law, including but not limited to anti-Spam legislation, which involves the mass distribution of unsolicited messages.

10.4. Publishing or promoting this programme on platforms that reference adult content, alcohol, tobacco, gambling, or unregulated health claims related to POMs is strictly prohibited.

10.5. You must not at any time, invite or refer people who are unknown to you.

10.6. You must only use our Referral Programme for personal use and refrain from its use for commercial purposes.

11. Termination

We may terminate this Referral Programme at any time, including your participation or the availability of its benefits.

12. Exclusive Relationship

12.1. You understand and agree that you are only the User of our services and/or products, and refrain from implying any other affiliation or legal relationship with us.

12.2. You understand and agree that you are never authorised to legally bind our company.

12.3. You must never create any materials that contain our branding, trademark, (part of) our corporate identity.

12.4. By participating in the Referral Programme you must not represent yourself as a duplicate, agent, or intermediary of our company.

13. Privacy and Information

13.1. You undertake to respect the privacy rights of the people you invite to our Referral Programme and direct to our website.

13.2. When referring to other people, you must always inform them about the applicable terms and conditions and privacy policy. You must do so before they participate in the Referral Programme.

14. Amendments

We may amend the terms and conditions of our Referral Programme. We may offer and/or restrict additional incentives, benefits, and programmes. As a result, additional terms may apply. You agree that you are aware of those amended and additional terms.

15. Violations and Termination

15.1. In case we suspect any violations of these terms or otherwise tampering with, fraud, or unreasonable use of our Referral Programme, we may in our sole discretion cancel the distribution of any discount, benefit, or payout.

15.2. If you are a current or former employee, contractor, or affiliate of our company, we may restrict your participation in the Referral Programme, and we may restrict or cancel your participation with immediate effect.

15.3. You must comply with all applicable laws and regulations, and refrain from violating any third-party rights. These rights include any copyright, trademark, or other proprietary rights.

15.4. Any claim that implies or highlights benefits specific to POMs as part of the referral programme will be considered a violation and grounds for termination of participation.

16. Disclaimer and Indemnification

16.1. We offer our Referral Programme and its benefits only on an “as is” and “as available” basis. We may remove, change, and update the Referral Programme in our sole discretion. We will never make any promises or guarantees about the content and information of our Referral Programme. We disclaim our responsibility for any information that is incorrect or has errors.

16.2. Our Referral Programme is based on our best efforts. You acknowledge and agree that we can never guarantee any benefit or result from participating in the Referral Programme.

16.3. You will defend, indemnify, and hold Medic Spot Limited harmless from and against all claims, damages, liabilities, losses, expenses, and costs (including reasonable legal fees) arising out of your participation in the Referral Programme.

17. No Correspondence, Disputes, and Refunds

With regards to the distribution of discounts, vouchers, incentives, prizes, awards, or other benefits, no correspondence will be entered into. Moreover, we shall never respond to any complaint or accept any dispute about the Referral Programme, and the abovementioned benefits are provided “as is” and we never refund or exchange such benefits.

No correspondence regarding the distribution of incentives that implies the promotion of POMs will be entertained. All claims regarding POM-related issues must be addressed with strict adherence to MHRA guidance.

18. Applicable Law

The law of England and Wales shall apply and the courts of England and Wales are competent to hear any claim that may arise out of these terms.
